1. Data Collection

We collect your Email address and Hardware Identifier (HWID) strictly for license validation and anti-piracy purposes via our software.

2. Payments

Payments are processed by LemonSqueezy, acting as the Merchant of Record. We do not store or have access to your full credit card details. Please refer to LemonSqueezy's Privacy Policy for payment data handling.

3. Third-Parties

We use Vercel for website hosting. No personal data is sold or rented to third parties for advertising.

4. Compliance

This policy is in accordance with the Swiss Federal Act on Data Protection (FADP) and GDPR where applicable.

1. Agreement & Delivery

By downloading, installing, or using CLUBCORE, you agree to these terms. Products are delivered digitally via a download link immediately after purchase.

2. Orders, Pricing & Merchant of Record

Our order process is conducted by our online reseller LemonSqueezy. LemonSqueezy is the Merchant of Record for all our orders and handles all billing, tax calculation, and payment inquiries. By completing a purchase, you also agree to LemonSqueezy's Checkout Buyer Terms (https://www.lemonsqueezy.com/terms). Prices may change at any time, but purchases are final at the price paid.

3. License Grant & Activations

The Publisher grants the User a personal, limited, non-exclusive, non-transferable license.

• Activations: Limited to a maximum of 3 simultaneous activations.
• Instances: Each format or execution mode (VST3, AU, CLAP, Standalone) counts as a distinct activation, even on the same physical machine.
• HWID: The Software uses a hardware binding mechanism to validate licenses.

4. Permitted Use

You are authorized to use CLUBCORE for:

• Creating commercial or private audio content (musical productions, mixing, soundtracks, live performances).
• Royalty-Free: No royalties are due to the Publisher for works created using the Software.

5. Prohibited Use

You may NOT:

• Share, resell, rent, loan, or redistribute license keys or the Software (including "License Transfers").
• Reverse engineer, decompile, disassemble, or attempt to bypass the AES-256 encryption and security features.

6. System Requirements & Support

• Requirements: You are responsible for ensuring your system meets the minimum requirements for our products. You must test the "Lite Mode" before paying for the license to verify proper functioning.
• Updates & Upgrades: Minor updates are provided free of charge to license holders. Major upgrades may require an additional paid upgrade fee. All updates and upgrades are provided at the Publisher's discretion.

7. Liability & Sound System Warnings

• Sound System Warning: CLUBCORE is a signal processor capable of generating extreme sound pressure levels in low frequencies.
• Material Damage: The Publisher shall not be held liable for damage caused to your sound reproduction equipment (e.g., speaker membrane rupture, amplifier failure) resulting from inappropriate use or excessive gain, particularly if software protection limits ("Knob Limits") are disabled.
• Hearing Health: Prolonged exposure to high sound levels can cause irreversible hearing damage. The User assumes full responsibility.
• Warranty: The Software is provided "AS IS", without warranty of any kind.

8. Refund Policy (No Right of Revocation)

Given the digital nature of the Software, and because the User has the opportunity to fully test the product via the free "Lite Mode" prior to purchase, the User expressly agrees to waive any right of withdrawal or refund once the unique license key has been generated. All purchases are final.

9. Termination & Changes

We reserve the right to immediately terminate or revoke your license without notice if you violate these terms (e.g., attempting to bypass security). We may update these terms at any time; continued use constitutes acceptance.

10. Governing Law

This Agreement is governed by Swiss substantive law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
